Terms and conditions
Introduction
Fidell is a service offered by Paddock Animal & Cie that allows you to automatically receive, on a regular basis and at a selected address, the items you purchase for your pet, while benefiting from a discount of up to 7% on these items (hereinafter "Fidell"). These items will be automatically ordered for you on a date you select (the "Scheduled Order Date").
Acceptance
2.1. Authorization
By selecting "FIDELL - Turn into a recurring order" you agree to complete the information requested in the secure link that will be sent to the e-mail address indicated on the account linked to the transaction. Once completed, the subscription will begin and the first order will be shipped.
2.2. Membership
By subscribing to the Fidell program, when you make purchases through the Paddock Animal & Cie website, you agree to be bound by these terms of service and all other policies in effect on the Paddock Animal & Cie website, including the terms of sale. If you do not agree with these terms of service, please do not participate in the Fidell program.
2.3 Updates
We invite you to periodically consult the various policies and conditions available on the Paddock Animal & Cie website to ensure that you are always aware of the extent of your obligations and rights towards Paddock Animal & Cie.
Terms and conditions
3.1 Customer responsibility
The management of Fidell orders is your sole responsibility. As such, it is your responsibility to keep all information relating to your Fidell orders up to date, including but not limited to your Fidell shopping cart, payment information and address, and to ensure that quantities, scheduled order dates and items ordered are accurate and desired.
3.2 Invoicing
Payment for your Fidell order is due on the scheduled order date. The price charged to you for each item available through the Fidell program will be the price of each item on the day of the scheduled order date. You agree to pay the total price of your items plus applicable taxes and fees on the date of the scheduled order by the method of payment identified in section 3.9. Paddock Animal & Cie reserves the right to modify the price of certain Fidell program items at any time, without prior notice.
Paddock Animal & Co. may change the scheduled order date in certain circumstances, such as if your payment method has not been successfully established or if the scheduled order date does not exist in a given month. If the expected order date falls on a date that does not exist in a given month, the expected order date will be the last day of that month.
3.3. Up to 7% discount
Provided you are not in default to Paddock Anial & Co. under these terms of service or any other applicable terms and conditions or policies, Paddock Animal & Co. will apply up to a 7% pre-tax discount on any purchase made through the Fidell program directly to your invoice on the day of the scheduled order date.
3.4. Automatic renewal
Unless you terminate your Fidell service no later than the day before the Scheduled Order Date, your Fidell Program items will automatically be ordered on the Scheduled Order Date. You can expect to receive your shipment between 1 and 4 business days.
Please note that exceptionally, some products may take 4 to 5 business days for delivery. Please consult our delivery policy for further details.
3.5. Modification or cancellation by the customer
You may cancel your Fidell program subscription at any time prior to the scheduled order date by contacting us by e-mail at [email protected]. The cancellation of your Fidell program will then take effect.

You may modify any information related to a Fidell order, including items, delivery frequency, or postpone a Fidell delivery, at any time prior to the scheduled order date, by contacting us at [email protected]. To modify your delivery information, you can do so directly in your account settings at Paddockanimal.ca. The change will then take effect. To change your payment information and modify or delete a credit card, simply contact us by e-mail.
3.6. Availability
Items covered by the Fidell program are subject to availability. Paddock Animal & Co. reserves the right to limit or change the items available through Fidell at its sole discretion.
3.7. Out-of-stock items
Any item that is backordered will not automatically be delivered on the scheduled order date. You will be notified by e-mail on the scheduled order date. If the item is available again on the next scheduled order date, it will be delivered in the quantity requested for that scheduled order date.
3.8. Refusal and limitation
Paddock Animal & Co. reserves the right to refuse, cancel or modify, at its sole discretion and without prior notice, any Fidell order and all related benefits that is made either improperly, in violation of these Terms of Service or in violation of any other terms and conditions or policies to which you are subject including, without limitation, imposing quantity limits or refusing an order in whole or in part.
3.9. Method of Payment
The method of payment accepted by Paddock Animal & Cie to pay for your purchases is by Canadian credit card only, i.e. Visa and MasterCard. By providing your credit card number, you declare that you are the holder of the credit card or that you are duly authorized to use it by the cardholder. Paddock Animal & Cie reserves the right to cancel a Fidell transaction and all related benefits if the method of payment provided cannot be verified, is invalid or is otherwise unacceptable.
Please ensure at all times that the credit card provided is valid. You must inform us immediately of any theft of your credit card and provide a new credit card without delay. Please refer to section 3.5 for more information about changing your information.
When you place an order with a Fidell program item, Paddock Animal & Cie automatically saves your credit card by default. This ensures that payment is accepted for each Fidell order and that you receive your order on the scheduled order date.
3.10. Returns
Please refer to our Return Policy which applies to all returns including items ordered through the Fidell program.
3.11. Warranty
Please refer to our Terms and Conditions of Sale which apply to all sales of items including items ordered through the Fidell program.
Limitation of liability
Nothing in these Terms of Service including the "Limitation of Liability" section shall attempt to exclude any liability that cannot be excluded under any consumer protection law.
To the fullest extent permitted by law, under no circumstances shall Paddock Animal & Cie, its affiliates, directors, officers, employees, agents and representatives be liable for:
4.1. Your use of the Fidell Program as contemplated herein (including, without limitation, any delay in the processing or delivery of an order for any reason whatsoever).
YOU AGREE TO WAIVE ANY AND ALL CLAIMS AGAINST PADDOCKANIMAL & CO. IN CONNECTION WITH FIDELL PROGRAM PURCHASES MADE ON THE PADDOCKANIMAL.CA WEBSITE.
Survival
Obligations under Section 4 (Limitation of Liability) shall survive termination of these Terms of Service.
General
6.1. Capacity
You represent that you are of legal age in your province or state of residence.
6.2. Applicable law and choice of jurisdiction
These terms of service are governed by the laws of Quebec and Canada, to the extent applicable. Any claim or legal action brought in connection herewith shall be brought exclusively in a court of competent jurisdiction in the Province of Quebec, judicial district of Montreal, Canada.
6.3 Indivisibility and Entirety
These Terms of Service constitute the entire agreement between you and Paddock Animal & Cie. The invalidity of any part of these Terms of Service shall not invalidate any other part of these Terms of Service, which shall remain in full force and effect.
Assignment
These Terms of Service may not be transferred or assigned by you, but may be transferred or assigned by Paddock Animal & Cie without restriction or notice.
